The September 11th Victims Compensation Fund can only hesitatingly find its place within a comprehensive study of reparation programs. While the origin of the Fund lies in the political exigencies surrounding a perceived threat to the security of the United States, it more accurately reflects the desire by the U.S. Congress to ensure the viability of its nation’s air carriers. Unlike traditional reparations which are closely related to a process of social reintegration of the victim, fostering civic trust and social (...) solidarity, the Fund was not established to bring justice to the victims of the terrorist attacks on September 11, 2001. Also, unlike traditional reparations, the Fund did not seek to serve as a mechanism of corrective or distributive justice as a result of an authoritarian domestic regime or internal conflict. It was initially created out of fear that recourse to the U.S. courts would threaten the precarious financial health of the airline industry. Implicitly, however, such pragmatism reflected a desire by lawmakers that the government be seen as doing all it could to ease the pain of those who suffered so greatly on September 11, 2001. Initial motivations for the program aside, there is no question that the compensation scheme has since taken on a life of its own. Ultimately, the Fund’s contribution to any reparations case-study lies in its cautionary tale about the creation of elaborate administrative schemes that try to individualize recoveries as the mechanisms through which to compensate victims. In this paper, our goal is to survey some of the legal contexts within which violence risk assessment already plays a prominent role, explore whether developments in neuroscience could potentially be used to improve our ability to predict violence, and discuss whether neuropredictive models of violence create any unique legal or moral problems above and beyond the well worn problems already associated with prediction more generally. In Violence Risk Assessment and the Law, we briefly examine the role currently played by (...) predictions of violence in three high stakes legal contexts: capital sentencing, civil commitment hearings, and sexual predator statutes. In Clinical vs. Actuarial Violence Risk Assessment, we briefly examine the distinction between traditional clinical methods of predicting violence and more recently developed actuarial methods, exemplified by the Classification of Violence Risk software created by John Monahan and colleagues as part of the MacArthur Study of Mental Disorder and Violence [1]. In The Neural Correlates of Psychopathy, we explore what neuroscience currently tells us about the neural correlates of violence, using the recent neuroscientific research on psychopathy as our focus. We also discuss some recent advances in both data collection and data analysis that we believe will play an important role when it comes to future neuroscientific research on violence. In The Potential Promise of Neuroprediction, we discuss whether neuroscience could potentially be used to improve our ability to predict future violence. Finally, in The Potential Perils of Neuroprediction, we explore some potential evidentiary, constitutional, and moral issues that may arise in the context of the neuroprediction of violence. Drug promotion should be evaluated according to its impact on health, access to information, informed consent, and wealth. Drug promotion currently does more harm than good to each of these objectives because it is usually misleading. This is a systemic problem. Whilst improved regulation and education will address it to some degree, major reforms to payment systems for drug companies and doctors are also required. Until all these systemic reforms can be put in place, the best policy option is to (...) ban the promotion of drugs to doctors and the public. One reason that Gramsci's writings are becoming ever more studied in the English-speaking world is their non-reductive approach. Today, the fact that a general theory of language informs Gramsci's Prison Notebooks is increasingly being recognized. While some parts of the writings on language have been translated into English, so far only the Italian editions have allowed an evaluation of the significance and role of linguistic issues in Gramsci. The following will seek to reconstruct the connections between die theory of language (...) and the more familiar elements of Gramsci's thought. Hardy’s non-locality paradox is a proof without inequalities showing that certain non-local correlations violate local realism. It is ‘possibilistic’ in the sense that one only distinguishes between possible outcomes (positive probability) and impossible outcomes (zero probability). Here we show that Hardy’s paradox is quite universal: in any (2,2,l) or (2,k,2) Bell scenario, the occurrence of Hardy’s paradox is a necessary and sufficient condition for possibilistic non-locality. In particular, it subsumes all ladder paradoxes. This universality of Hardy’s paradox is not true (...) more generally: we find a new ‘proof without inequalities’ in the (2,3,3) scenario that can witness non-locality even for correlations that do not display the Hardy paradox. We discuss the ramifications of our results for the computational complexity of recognising possibilistic non-locality. (shrink)

This paper attempts to provide, through a reading of Derrida's Rogues, an account of the political phenomenon where regimes of sovereignty are resisted in the name of the very values — freedom, democracy and human rights, for example — they purport to stand for. To Derrida, sovereignty must simultaneously conform to a logic of both self-identity and of unconditionality. However, the unconditionality that makes sovereignty possible will always threaten and exceed it, something that other accounts like Agamben's try implicitly to (...) deny. In the end, for Derrida, our present political challenge is to recognize, and even affirm, the way the unconditionality of sovereignty is turned against itself. Sovereignty, then, is most effectively dealt with not by imagining a world in which it will no longer occur, nor by simple opposition, but by committing to the very logic of sovereignty itself. People with dementia have commonly been excluded from research. The adverse impacts of this exclusion are now being recognized and research literature, position statements, and ethics guidelines increasingly call for inclusion of people with dementia in research. However, few published studies investigate the views of potential participants on taking part in research should they experience dementia-related cognitive impairment. This cross-sectional survey examined the views of people aged sixty and older attending hospital outpatient clinics about clinical research participation if they had (...) dementia and impaired decision-making ability. Over 90 percent of respondents were agreeable to participating in a wide range of research activities, such as cognitive testing, physical measurements, imaging procedures, and blood draws. For drug studies, however, agreement dropped to 60 percent. Altruism was a strong motivator for research participation. In regard to who should be involved in decisions about their participation in research during periods of incapacity, respondents mostly preferred the person they appoint as their substitute decision-maker for healthcare matters or a doctor or health professional on the research team. Over three-quarters expressed interest in making an advance research directive. The study findings are discussed in relation to law reforms in Australia that aim to strengthen respect and inclusion for people with impaired decision-making capacity, especially by providing frameworks for advance planning for research participation. The global pesticide complex has transformed over the past two decades, but social science research has not kept pace. The rise of an enormous generics sector, shifts in geographies of pesticide production, and dynamics of agrarian change have led to more pesticide use, expanding to farm systems that hitherto used few such inputs. Declining effectiveness due to pesticide resistance and anemic institutional support for non-chemical alternatives also have driven intensification in conventional systems. As an inter-disciplinary network of pesticide scholars, we (...) seek to renew the social science research agenda on pesticides to better understand this suite of contemporary changes. To identify research priorities, challenges, and opportunities, we develop the pesticide complex as a heuristic device to highlight the reciprocal and iterative interactions among agricultural practice, the agrochemical industry, civil society-shaped regulatory actions, and contested knowledge of toxicity. Ultimately, collaborations among social scientists and across the social and biophysical sciences can illuminate recent transformations and their uneven socioecological effects. A reinvigorated critical scholarship that embraces the multifaceted nature of pesticides can identify the social and ecological constraints that drive pesticide use and support alternatives to chemically driven industrial agriculture. Machiavelli's New Modes and Orders is the only full-length interpretive study on Machiavelli's controversial and ambiguous work, Discourses on Livy. These discourses, considered by some to be Machiavelli's most important work, are thoroughly explained in a chapter-by-chapter commentary by Harvey C. Mansfield, one of the world's foremost interpreters of this remarkable philosopher. Despite China’s recent remarkable performance in high-quality research, the number of students going abroad to pursue doctoral degrees in STEM fields has been rising rapidly. This study investigates the motivations of Chinese international doctoral students in STEM fields for undertaking a PhD abroad, and the external factors influencing this major life decision. Based on in-depth interviews with 35 CIDS from seven universities in four Australian states, the findings show that for the current generation, enriching life experiences and self-cultivation emerged as (...) most prominent personal motivations. The choice to study abroad, though ultimately a personal decision, was influenced by a range of factors and particularly long-term cooperation between host and home institutions. Both academic and personal reputation of supervisors played important roles in the selection of host institutions. This study applied psychographic segmentation theory to explore the psychological type profile of 1082 visitors to four cathedrals (three in England and one in Wales) and to set this profile alongside the published national normative data. Data provided by the Francis Psychological Type Scales demonstrated that among cathedral visitors there were more introverts (60%), sensing types (72%) and judging types (80%), with a balance between thinking types (49%) and feeling types (51%). Comparisons with the population norms demonstrated that extraverts and (...) perceiving types were significantly underrepresented among visitors to these four cathedrals. The implications of these findings are discussed for enhancing the visitor experience of those currently visiting and for attracting those psychological types currently less likely to visit. CONTRIBUTION: Situated within the science of cathedral studies, this article demonstrates (by means of applying psychographic segmentation theory and gathering data from four cathedrals) that extraverts and perceiving types were significantly under-represented among cathedral visitors. Plimpton 322 is one of the most sophisticated and interesting mathematical objects from antiquity. It is often regarded as teacher’s list of school problems, however new analysis suggests that it relates to a particular geometric problem in contemporary surveying.

During sudden school closures in spring 2020 due to the COVID-19 pandemic, teachers had to move to distance teaching. This unprecedented situation could be expected to influence teacher well-being and schools as organizations. This article reports a qualitative study that aims at understanding how changes in teachers’ professional lives that were related to school closure affected Swiss primary teachers’ professional well-being. In semi-structured online-interviews, 21 teachers from 15 schools sampled by snowball method reported their experiences during school closure and distance (...) teaching and how this situation influenced their professional well-being. Results showed that medium to high levels of teacher well-being could accompany a general negative evaluation of the move to distance teaching. Factors such as high work-load, social distancing and feelings of lack of competence and self-efficacy were among the most aversive aspects of distance teaching and associated with deteriorating professional well-being. Among a plethora of factors that supported teachers in maintaining their well-being, contextual work-related aspects such as school resources, collegial support or leadership support along with individual aspects such as resilience, coping strategies, and clear work structures were important. Additionally, it was found that teacher well-being was nourished by positive experiences with the new forms of distance teaching and feelings of professional mastery. Despite methodological limitations, the findings of this study could inform schools and authorities about what is needed to support teacher well-being and might help to develop organizational strategies that aim at preventing harmful declines in teacher well-being during challenging and difficult times such as a pandemic. Although this absolute hospitality is commonly read as the aspiration to which all of our practices of hospitality should tend, Derrida proposes a series of examples that show the dangers implicit in an automatic or limitless welcoming. The most famous of these is that of the Old Testament patriarch, Lot. Nothing is more definitive of war than its relationship with peace. But what is peace? This paper investigates the problematic nature of peace in the philosophical discourse on war, by investigating two key strands of thinking. Firstly, Hobbes and Foucault see peace as the place where the impulses that give rise to war can be re-directed and even satisfied, often in disguise. Another strand, in Kant and Levinas, different but not fully separable from the first, sees peace as what lies (...) beyond war, though war must be endured in order to reach it. These different accounts present war and peace not as binary opposites, nor even as fully distinguishable from one another. Instead, they are shown to be mutually dependant and entangled with one another. The paper ends with a brief analysis of the January 6, 2021 insurrection in the United States, in order to illustrate this complex entanglement between war and peace and reveal the obscure, even hallucinatory nature of the concept of peace. With the analysis and reduction of capital into labor, the possibility of freedom in this new meaning, which is merely asserted in the "humanism" of his earlier writings, is proven and secured with the necessity of science. In the present paper, I present and discuss some new information about the life of Paul Wittich from Wrocław, Poland (formerly Breslau, Germany), an elusive mathematician and astronomer of the late 16th century. Wittich seems to have played a significant role in the emergence of two important, though short-lived, developments of late 16th-century science: the so-called prosthaphaeresis calculating method, and the geoheliocentric model of the universe usually attributed to Tycho Brahe. His role in both achievements, however, has not been sufficiently (...) explained so far, and it is my belief that one of the main obstacles to that endeavor has been our scarce knowledge about the details of Wittich's life. Thus, I attempt to reconstruct his life with aim of being able to evaluate, eventually, his involvement in the development of mathematics and astronomy towards the end of the 16th century, primarily with the use of whatever scant sources can be found concerning Wittich. The source that I present here—a notebook of Bartholomäus Scultetus, an astronomer from Görlitz—is known and has already been used, but only to a limited extent by the community of historians of science, or by those of astronomy and mathematics. By presenting the information about Wittich from Scultetus's notebook, I aim to bring this source to the attention of those communities, clarify some hitherto unclear details from Wittich's life, and set out new paths for further investigation into his biography. SummaryIn An Essay upon Civil Government (1722), Andrew Michael Ramsay mounted a sustained attack upon the development throughout English history of popular government. According to Ramsay, popular involvement in sovereignty had led to the decline of society and the revolutions of the seventeenth century. In his own time, Parliament had become a despotic instrument of government, riven with faction and driven by a multiplicity of laws that manifested a widespread corruption in the state. Ramsay's solution to this degeneracy was the (...) extirpation of Parliament, and its substitution with a monarchy moderated by an aristocratic senate. Ramsay's adoption of certain “Country” elements, including a return to the first principles of the constitution, claimed to reflect the principles of contemporary French aristocratic theory which called for the reform of government through the nobility. In his desire to exclude popular government, and reverse the decline of the state, however, Ramsay utilised the theory with which Bossuet had defended Louis XIV's absolute France. Intriguingly, traces of the natural law system which fortified Ramsay's theory can be found in Viscount Bolingbroke's subsequent attack on Walpole's Whig ministry and the corruption of the state. Democracy is usually identified with openness, order and pluralism and thus peace. Yet, everywhere, from the political convulsions that bring it into being to the wars that aim to extend it, democracy is violent. Usually this violence is seen as accidental or forced upon democracy. The aim of this paper is to argue that the violence of democracy springs from its inextricable if denied relationship to revolution, the drive to re-found the political order properly and definitively. Through a reading of (...) Derrida’s account of the relationship between violence and justice in Walter Benjamin, violence is identified as the unstable founding moment which democracy must both pass through in order to emerge and also endlessly recall in its drive to both expand and complete its mission. The Chinese traditionally have valued sons over daughters, depending on their sons to support them in old age. Recent changes, however, suggest a shift toward greater gender equality, with daughters also keeping elderly parents. The present study, undertaken in 1979 in the People's Republic of China, assessed attitudes of 48 university staff members toward financial support for aged parents and living arrangements in old age, with an emphasis on gender differences. We found that most sons and daughters gave financial support (...) to their parents regularly and most men and women still believed adult children should share housing with their aged parents. In this sample, the sons assumed this responsibility far more than the daughters, and few of the respondents believed their parents should live with a daughter. However, when asked to project their own preferences in old age, sons thought they would prefer to live with a son, but daughters feel they would like to live with a daughter. These results are discussed in terms of two important cultural changes, the new marriage laws and the one-child policy, that were implemented at the time of the study. (shrink)

Rights theorists tend to take tempi pacifici for granted, but it is precisely in emergencies that rights are most difficult to protect and most in need of protection. Two remedies are: first, to be successful in emergencies and second, to establish a free government capable of handling emergencies. These remedies play no role in the thinking of the ACLU, which has increasingly come to define the public's understanding of rights. For the ACLU, a right is not a right unless it (...) can be carried to an extreme and used irresponsibly. A better liberal theory, with instruction from Machiavelli, will seek to combine our interest in security with our assertion of rights. (shrink)

No topic has caused more discussion in recent philosophy and political theory than sovereignty. From late Foucault to Agamben, and from Guantanamo Bay to the 'war on terror,' the issue of the extent and the nature of the sovereign has given theoretical debates their currency and urgency. New thinking on sovereignty has always imagined the styles of human selfhood that each regime involves. Each denomination of sovereignty requires a specific mode of subjectivity to explain its meaning and facilitate its operation. (...) The aim of this book is to help outline Jacques Derrida's thinking on sovereignty - a theme which increasingly attracted Derrida towards the end of his career - in its relationship to subjectivity. It investigates the late work Rogues: Two Essays on Reason, as not only Derrida's fullest statement of his thinking on sovereignty, but also as the destination of his career-long interest in questions of politics and self-identity. The book argues that in Derrida's thinking of the relationship between sovereignty and subjectivity - and the related themes of unconditionality and ipseity - we can detect the outline of Bataille's adaptation of Freud. Freud completed his 'metapsychology,' by defining the 'economic' nature of subjectivity. In Bataille's hands, this economic theory became a key to the nature of inter-relationship in general, specifically the complex and shifting relationship between subjectivity and power. In playing with Bataille's legacy, Derrida connects not only with the irrepressibly outrageous thinking of philosophy's most self-consciously transgressive thinker, but with the early twentieth century scientific revolution through which 'energy' became ontology. As with so many of the forebears who influenced him, Derrida echoes and adapts Bataille's thinking while radically de-literalising it. The results are crucial for understanding Derrida's views on power, subjectivity and representation, as well as all of the other key themes in late Derrida: hospitality, justice, otherness and the gift. This study on the cambium of Pinus sylvestris L. examines the intrusive growth of fusiform cambial initials and its possible contribution to the tangential and radial expansions of the cambial cylinder. The location and extent of intrusive growth of the fusiform initials were determined by microscopic observations and by mathematical modeling. In order to meet the required circumferential expansion of the cambial cylinder, the fusiform initials grow in groups by means of a symplastic rather than intrusive growth, leaving no room (...) for the assumption that intrusive growth of the initials takes place between radial walls and has a direct role in the increase of the cambial circumference. Therefore, it is postulated that the fusiform initials grow intrusively between the tangential walls of the neighboring initials and their immediate derivatives and not between the radial walls of the adjacent initials as per common belief.
